Summary

This position provides experienced data privacy legal counsel and general contracts support Pearson's business in the United States and globally, providing day to day legal, contractual and regulatory matters involving data privacy and in K-12 markets we support. The individual in this position also will have a major role to play in programs supporting the Pearson privacy framework. The individual in this role must be a qualified, licensed attorney in the United States or Canada with a minimum of five (5) years' experience in the data privacy field and ideally will have experience of data privacy in the education sector in North America. This position reports to the SVP and General Counsel.

Key Responsibilities

Specific tasks include:

Provide guidance, support and training on privacy and data protection legislation and regulations. Support the Business in negotiating and maintaining compliance with data privacy provisions in customer contracts.

Prepare consents, notifications, data privacy contract terms and website privacy policies. Advise and collaborate with other Legal Department staff to ensure that legal forms, agreements, policies and notices in North America protect Pearson's commercial and legal position in relation to data privacy.

Collaborate with Business in responding to data privacy-related inquiries and preparing internal and external communications concerning data privacy.

Support the development and roll out of Pearson's privacy framework in North America and globally.

Support the Business in keeping up to date with relevant, new data privacy developments around the world.

Support Pearson's strategy and business objectives by providing counsel and guidance on data privacy, conducting data privacy training and facilitating awareness relating to data privacy.

Provide guidance, advice and support to business teams with respect to data privacy provisions in vendor contracts, vendor privacy assessments, including development and improvement of business specific risk management processes, vendor training and compliance.

Assess the impact of new regulations or laws on Pearson's existing operations and offerings; advise and collaborate with the Technology function, CISO and the Product Development teams to ensure that systems and products are aligned with corporate data protection policy and that development roadmaps foster privacy by design.

Collaborate with CISO, Procurement and other relevant teams to refine current processes around vendor risk assessments; risk treatment (mitigation); risk monitoring and review and risk reporting

Collaborate with the Security Operations Center, CISO, and Business Resilience, to ensure an aligned approach to incident response and breach preparedness, including thorough review of response plan(s), and organizing table top exercises to effectively address and manage any actual or suspected breach or compromise of the confidentiality and security of personal information. Work collaboratively on communications. Prepare legally required notifications and engage with regulatory and government authorities, as applicable.

Review and draft revenue and partnership agreements, manage contract lifecycle, modifications, amendments and renewals,

Draft contract terms for new product offerings and ensure compliance with applicable state and federal regulations

Remain up to date on legal and regulatory requirements affects contracts, offerings, RFPs, and bids/contracts for instructional materials.

Qualifications

Education

The successful candidate should hold a law degree from a well-regarded and accredited university or law school and be admitted to practice law in at least one state in the United States. Ideally, the candidate would hold one or more IAPP data privacy certifications.

Experience

The successful candidate must be an experienced attorney with the legal background, presence and interpersonal skills sufficient to function successfully in a highly visible and challenging position. It is strongly preferred that he/she brings the following to the role:

* A minimum of five (5) years' relevant experience as a practicing lawyer (either in-house or with a well-regarded law firm).


* Detailed knowledge of data protection/privacy requirements, laws and regulations in North America and around the world.


* Ideally, data privacy experience in the education sector in North America and be knowledgeable about FERPA, COPPA and other student data privacy legislation, as well as GDPR in Europe.


* The ability to work collaboratively and to engage and influence in a matrix organization.


* Strong interpersonal and influencing skills which can be applied to both internal and external relationships, with the ability to manage potential conflicts sensitively and reconcile compliance requirements with business needs as far as is possible.


* Strong advocacy and negotiation skills. Ability to engender trust, respect and confidence. Ability to function autonomously yet understanding of the need to advise management of work progress and unusual situations.


* Able to communicate at all levels with clarity and precision, both written and verbally, within team and direct stakeholders, across the organization and with external parties. Able to communicate technical information clearly to leadership and diverse populations


* Exemplary personal and professional integrity and business ethics. Exercises discretion and maintains confidentiality of sensitive information.


* Ability to make responsible decisions; under the supervision of the General Counsel


* Education businesses experience a plus


* A hands on practical approach - the role will include performing more detailed tactical tasks work as well as the strategic aspects


* Awareness of latest risk management and compliance practices
