We are currently looking to recruit a Head of Claims & Litigation Americas

Location: St. Bruno (Montréal) or Pittsburgh or Mississauga (Toronto)

YOUR ROLE

The Head of Claims and Litigations Americas is responsible for all major claims for the Americas region (as so identified by the AME Claim Review Board ("CRB")) and for AME`s Litigations (Claims that have been escalated to court or arbitration).

The Head of Claims and Litigations Americas is responsible for all steps leading to a final settlement or binding decision, from the claim preparation and assessment to the enforcement of the settlement or court/arbitration decision.

YOUR RESPONSIBILITIES

1. Lead, support and monitor major claims and Litigations, including initial assessment, preparation, data collection, strategy for substantiation, elaboration of strategy, negotiation, settlement, obtaining binding court/arbitration decisions and enforcement of settlement and court/arbitration decisions. Liaise, as necessary, with internal and external stakeholders, including external legal counsels.
2. Report major claims and Litigation and their developments to the CRB and through internal Bombardier's tools (Monthly Operational Review ("MOR"), Project Portfolio Reporting System ("PPRS") etc). Ensure internal governance processes and the Claim Management directives are followed. Prepare and participate in the Claim Review Board meetings. Develop relevant KPIs to monitor the Claims and litigations situation of the region.
3. Provide training and claim awareness sessions as appropriate and ensure that lessons learned and best practices in claim management are captured and properly communicated to team members and other stakeholders. Support team members analysing potential claim situations with our partners, suppliers and customers.
4. Liaise with the Human Resources department to ensure that the appropriate level of external legal assistance is obtained. Assist in the preparation of budgets for HR matters and oversee the use of external counsel and the invoices related thereto.

Qualifications

Qualifications

- Juris Doctorate Degree, LLB or equivalent essential
- Extensive working experience including at least 5 years as litigation lawyer
- Demonstrated & positive leadership capabilities with all levels of an organization
- Excellent negotiation & problem solving capabilities
- Ability to guide, engage and convince others and communicate complex concepts to stakeholders
- Ability and experience to lead and influence in a matrix structure
- Structured, independent and hands on working approach
- Experience of Legal claims within a complex organisation
- Legislation knowledge and implementation
- An enthusiasm and interest in our products and engineering is highly desirable
- Fluent in English essential with further languages highly desirable
