Position Overview

Baxter has launched a search for an Associate General counsel to primarily support the Pharmaceuticals Global Business Unit. The successful candidate will be the lead attorney for a wide variety of projects, including conducting patentability, freedom to operate, and third party infringement analyses; managing patent preparation and prosecution; managing and coordinating global patent litigation and other adversarial proceedings; drafting and negotiating IP-centric contracts; training and advising business and R&D colleagues on IP-related topics. S/he will act as a partner to the general manager and leadership team of the Pharmaceuticals business. S/he will help drive the Company's business, collaborating with senior attorneys dedicated to individual global businesses and other legal functions as well as commercial professionals and other operating functions around the world.

The person sought for this role will be a proven, high-potential candidate with deep pharmaceuticals expertise, strong intellectual and communication capability, technical skills, and an ability and desire to grow with the organization.

The successful candidate will have the opportunity to make an immediate contribution to Baxter's continuing growth and success. For the Pharmaceuticals business, s/he will have front-line responsibility for global intellectual property support for branded drugs, generic drugs, and biosimilars in a fast-paced, global environment; and will serve as the lead attorney for many projects for the business liaising with other attorneys, business and functional colleagues to provide advice and counsel. Baxter seeks a motivated, self-starter with excellent communication and judgment to take initiative and ownership of key projects, matters and transactions. S/he will be expected to partner closely with the business in a solutions-oriented manner.

Essential Duties and Responsibilities

* Lead and support all Intellectual Property aspects of Pharmaceuticals projects of varying degrees and nature.
* Work collaboratively across a broad range of people developing and maintaining strong working relationships between legal, finance, human resources, investor relations and other functions to facilitate a team based approach.
* Evaluate IP risks for launch of generic molecules under Hatch-Waxman.
* Evaluate IP risks for launch of biosimilars.
* Work with project teams and leadership to identify opportunities and balance risk.
* Juggle simultaneous projects and priorities.


* Proactively communicate and manage expectations with multiple constituencies.



Qualifications

Education and/or Certifications

* The successful candidate will hold a law degree and will have obtained an undergraduate degree from a college or university of recognized standing.
* S/he will be licensed in good standing to practice law in at least one state and one federal jurisdiction within the United States without any instances of suspension, revocation, censure or other adverse events in any jurisdiction.
* S/he will be licensed in good standing to practice before the U.S. Patent and Trademark Office.
* S/he will have a successful track record of experience, ideally gained in a combination of working in a major law firm and in-house corporate legal department. Prior work experience with a Pharmaceutical company is preferred.
* S/he should be comfortable with the technology surrounding both small molecule and large molecule (biologic) drugs. An undergraduate or advanced engineering or science degree in the chemical or biologic arts is required.

Skills, Knowledge, and Experience

* A seasoned, successful and proven Intellectual Property Attorney with significant pharmaceuticals and related experience.
* Minimum of ten (10) years of relevant experience.
* Extensive and sophisticated pharmaceuticals training and experience with a top tier law firm.
* Ideally brings a combination of both law firm and in-house. Additional exposure and experience from the pharmaceuticals industry, parameters and implications are highly desirable.
* Demonstrated management experience, including managing relationships with a diverse group of senior executives, cross functional teams and legal personnel in multiple jurisdictions.
* Excellent organizational, analytical and communication skills, oral and written.
* The ability to see the "big picture" and yet be highly organized and efficient, with demonstrated attention to detail.
